What Is Writ of Habeas Corpus?

Bedford Criminal Defense Attorney

What is writ of habeas corpus? It is a common term often used on television shows, but few people really understand what it is used for. After being arrested and taken into custody, you must be booked on formal charges within 24 hours or released. The term habeas corpus is Latin that literally translates to "You have the body."

If police do not present evidence sufficient enough for the prosecutor to charge you, they cannot deny you writ of habeas corpus — in other words, what evidence do they have for holding you in custody? To release a person by writ of habeas corpus after an arrest requires a judge's order. Unfortunately, an appropriate judge is not always available, especially on weekends, evenings and holidays.

The law offices of David E. Cook will work vigorously to find a judge and work until you are released from custody on writ of habeas corpus. We are your complete criminal defense law firm, representing individuals arrested and charged with misdemeanor and felony offenses in counties and communities throughout north Texas.
