Can an Alleged Victim Get the Charges Dismissed?

In some cases, a victim of domestic violence can persuade the state to dismiss the charges against the alleged abuser. Three things have to happen before this will even be considered:

  • Step one: If an alleged victim in a domestic violence case wants a prosecutor to dismiss charges, he or she must first attend one of the "alternatives" classes offered at a women's shelter.
  • Step two: After attending the women's shelter class, the victim must meet with the prosecuting attorney and sign an affidavit of non-prosecution.
  • Step three: After the victim meets with the prosecutor, the alleged abuser must take a "batterer's" course.

Because most district attorneys in Texas have a "no drop policy" for domestic violence cases, following these steps does not guarantee a dismissal. However, these steps will almost always help to improve any deal the state offers, should you decide to accept it.
